Second section General rules

§ 6 Minimum safety height, minimum height for cross-country flights according to visual flight rules


§ 6 has 1 earlier version and is quoted in 7 regulations


(1) The minimum safety height may only be undershot if it is necessary for take-off and landing. The minimum safety level is the level at which there is no need to fear unnecessary noise pollution within the meaning of Section 1 (2) or, in the case of an emergency landing, any unnecessary danger to people or property. Above cities, other densely populated areas, industrial plants, crowds of people, accident sites and disaster areas, the minimum safety height is at least 300 meters (1,000 feet) above the highest obstacle within a radius of 600 meters, in all other cases 150 meters (500 feet) above ground or water . Gliders, hang-gliders and paragliders can also fall below the height of 150 meters (500 feet) if the nature of their operation makes this necessary and there is no danger to people or property.


(2) Bridges and similar structures as well as overhead lines and antennas must not be flown under.


(3) Overland flights according to visual flight rules with motor-powered aircraft are to be carried out at an altitude of at least 600 meters (2,000 feet) above ground or water, unless a higher altitude is to be maintained for safety reasons according to paragraph 1 sentences 2 and 3. Cross-country flights at an altitude of less than 600 meters (2,000 feet) above ground or water may be undertaken or carried out in compliance with the provisions of paragraphs 1 and 2, provided that other regulations and stipulations according to this ordinance are complied with, in particular compliance with the airspace regulation according to Section 10 , the visual flight rules according to § 28 or air traffic control clearances, requires a lower altitude.


(4) For flights for special purposes, the locally responsible aviation authority of the country can allow exceptions for individual flights or a series of flights, provided this is necessary for the respective purpose and does not endanger public safety and order. If, as an exception, a fall below the minimum safety level above industrial plants, crowds of people, accident locations or disaster areas is permitted, the pilot is obliged:


1.
to report to a body designated by the aviation authority of the country before commencing the flight and to provide the following information:

a)
Place and time of use of the aircraft,

b)
the expected duration of the fall below the minimum security level and

c)
Aircraft registration number and type,

2.
to coordinate the execution of the flight with the responsible authority before the start of the flight,

3.
to maintain a constant readiness for radio reception while the minimum safety level is not reached and to pay attention to warning signals in accordance with Section 4 of Appendix 2,

4.
to remove himself from the area immediately upon request of the competent authority.

(5) Section 36 applies to flights under instrument flight rules.


(6) Paragraph 3 does not apply to military low-level flights and to operational flights by the Federal Police, civil protection and disaster control and the police forces of the federal states.
